1. Acceptance of Terms

By accessing, browsing or using this website, you acknowledge that you have read, understood and agree to be bound by these Terms of Service.

If you do not agree with these terms, you should not use this website.

2. Nature of Service

Onpoint Locksmith operates as a marketing and service coordination platform that connects customers with independent locksmith technicians.

When a customer requests locksmith services through our website or by phone, we coordinate the request and assign it to an available locksmith technician operating in the relevant area.

Onpoint Locksmith does not directly perform locksmith services. Locksmith services are carried out by independent subcontractor technicians who operate their own businesses.

Onpoint Locksmith does not supervise or control the work performed by subcontractor technicians and is not responsible for how services are carried out on-site.

3. Service Estimates and Pricing

Prices discussed over the phone or through our website are estimates only.

Final pricing may vary depending on factors including:

  • Lock type
  • Security level of the system
  • Complexity of the work
  • Tools or parts required
  • Time required to complete the job
  • On-site assessment by the technician

The customer acknowledges that pricing cannot be confirmed until on-site inspection and agrees to this condition before service is performed.

Where possible, the attending technician will confirm pricing before commencing work.

The customer has the right to decline the service after the final price is provided on-site. However, a call-out fee may still apply.

4. Call-Out Fees and Cancellations

A call-out fee may apply once a technician has been dispatched to the customer's location.

If the customer cancels the service after a technician has been dispatched or arrives on-site, a call-out fee may still be charged.

If the technician is unable to complete the work due to incorrect information provided by the customer, lack of access, or refusal to proceed after arrival, applicable fees may still apply.

5. Independent Subcontractors

Locksmith technicians who attend service requests are independent subcontractors and are not employees of Onpoint Locksmith.

These subcontractors are responsible for:

  • Performing the locksmith work
  • Their professional conduct
  • Tools and equipment used during the service

Onpoint Locksmith acts as a service coordinator and booking platform connecting customers with available technicians.

6A. No Agency Relationship

Nothing in these Terms creates any partnership, joint venture, or agency relationship between Onpoint Locksmith and any subcontractor technician.

Subcontractor technicians are independent service providers and are not authorised to act on behalf of Onpoint Locksmith beyond accepting service referrals.

6. Customer Responsibilities

By requesting locksmith services through this website or by phone, you confirm that:

  • You are the legal owner of the property, vehicle, or lock system involved, or
  • You have proper authorisation to request locksmith services for the property

Technicians may refuse service if they believe access is unauthorised, unlawful, or unsafe.

Customers must provide accurate information when requesting services.

Customers must not engage in abusive, threatening, or unsafe behaviour. Technicians may refuse or cease work in such circumstances.

7. Payment Terms

Payment for services is generally processed through Onpoint Locksmith after the completion of the job.

Customers agree to pay the full amount for services provided once the work has been completed.

In some cases, Onpoint Locksmith may collect payment on behalf of the attending locksmith technician and later compensate the technician for the services performed.

Failure to pay for completed services may result in collection procedures or legal action where permitted by law.

By approving the job on-site or proceeding with the service, the customer provides explicit authorisation for the work to be carried out and for payment to be processed.

Customers agree to contact Onpoint Locksmith in the first instance to resolve any concerns or disputes before initiating a chargeback.

Nothing in this clause limits the customer's rights under applicable laws or payment provider policies.

Onpoint Locksmith may act as an intermediary in processing payments but does not assume responsibility for the services performed by subcontractor technicians.

8. Emergency Services Disclaimer

While locksmith technicians may provide emergency services, response times cannot be guaranteed.

Arrival times may vary depending on:

  • Location
  • Traffic conditions
  • Technician availability
  • Weather conditions
  • Previous service calls

9. Damage Disclaimer

Certain locksmith services, particularly lockouts involving damaged or high-security locks, may require non-destructive or destructive entry methods, including drilling or removal of lock components.

By requesting locksmith services, customers acknowledge that reasonable procedures may be required to gain entry.

Onpoint Locksmith is not responsible for pre-existing damage or faulty lock mechanisms. Damage that occurs as a necessary and reasonable result of standard locksmith procedures may occur, and the customer acknowledges this risk.

Nothing in this clause excludes liability where it cannot be excluded under Australian Consumer Law.

10. No Guarantee or Warranty

To the maximum extent permitted by law, Onpoint Locksmith does not provide guarantees or warranties regarding the outcome, effectiveness, or longevity of locksmith services performed by independent subcontractor technicians.

Nothing in these Terms excludes, restricts, or modifies any rights or remedies the customer may have under the Australian Consumer Law.

11. Limitation of Liability

To the maximum extent permitted under Australian law, Onpoint Locksmith shall not be liable for any direct, indirect, incidental or consequential damages arising from:

  • Use of this website
  • Locksmith services provided by subcontractor technicians
  • Service delays or response times
  • Lock failures, security issues or property damage related to lock mechanisms

Nothing in these Terms excludes rights that cannot be excluded under the Australian Consumer Law.

To the extent permitted by law, liability is limited to the amount paid for the services in question.

12. Indemnity

The customer agrees to indemnify and hold harmless Onpoint Locksmith from any claims, damages, losses, or expenses arising from:

  • False or misleading information provided by the customer
  • Unauthorised service requests
  • Misuse of locksmith services
  • Any unlawful activity associated with the service request

13. Fraudulent or Unlawful Requests

Onpoint Locksmith reserves the right to refuse service where a request appears fraudulent, unlawful, or unsafe.

Locksmith technicians may require identification or proof of property ownership before performing services.

Technicians reserve the right to refuse or stop work at any time if they feel unsafe, if the request appears unlawful, or if proper identification or authorisation cannot be provided.

In such cases, a call-out fee may still apply.

14. Intellectual Property

All content on this website, including text, logos, branding, images and materials, is the property of Onpoint Locksmith and is protected by copyright and intellectual property laws.

No content may be copied, reproduced or distributed without prior written permission.

15. Third-Party Links

This website may contain links to third-party websites. Onpoint Locksmith does not control or accept responsibility for the content or privacy practices of those websites.

16. Changes to These Terms

Onpoint Locksmith reserves the right to modify these Terms of Service at any time.

Updated terms will take effect immediately once published on this website.
